Acceptable Use Policy – Updated on 03/02/2023
This Acceptable Use Policy specify the restrictions applied to the service you are subscribing from AbeloHost B.V. This policy is created and followed carefully to ensure the protection, integrity, reliability and privacy of AbeloHost B.V. as a web hosting provider. AbeloHost B.V. has the right to change this policy at any given time, and at the moment of its modification, it is put into effect immediately. You alone are responsible for all actions that occur during your use of AbeloHost’s services, and you agree not to use your services for causes that are prohibited.
Please note that this Acceptable Use Policy is subjected to change and it is Customer’s responsibility to regularly check for modifications. (Customers, users, and visitors are referred collectively as Customer).
Prohibited Content
Certain content is prohibited. You are responsible for any content transmitted, or accessed, using our network. Transmission, storage, or presentation of any information, data or material in violation of any applicable law or regulation is prohibited. You may not use our network to facilitate the violation of any particular law or regulation or this Acceptable Use Policy. The activities listed below are meant to provide you with examples of activities and content that are strictly prohibited by this Acceptable Use Policy and the list is not exhaustive. Use of our network to host content related to or to engage in the following activities is strictly prohibited.
– Any type of activity that can lead to the IP being blocked by organizations such as Spamhaus
– Under Legal Age Nudity
– Adult content involving real violence
– Adult content involving animals (bestiality or zoophilia)
– Scam/Fraudulent Websites
– Spam
– Illegal pharmaceutical websites
– Any websites associated with hacks or cheats
– Mass mailing
– Reverse proxies
– Selling illegal substances
– Phishing websites
– Botnet controllers
– DDoS scripts
– Brute Force attacks
– Packet Flood scripts
– SIP Scanners
– IP Spoofing Attacks
– Virus / Trojan / Malware Distribution
– Online surveys or survey-based websites
– Third-party software distribution or encouragement of users to download such software
– Scanning of password and password guessing tools, bots and/or software
– Scanning websites or ports for potential security vulnerabilities
– Vulnerability scanners
– Terrorist Websites
– Anything related to forex, banking or investment
– Anything related to ebooks
– Unlicensed IPTV services
– Anything related to in-game virtual currencies and generators thereof
– The sale or distribution of replica items
If you think your site may violate our Acceptable Use Policy, please ask us before signing up for an account so that we may determine if we can host your site. AbeloHost B.V. reserves the right to determine what is and what isn’t acceptable on our network.
Content Considerations
The following is a list of restrictions that apply to the specified operations in our servers and network.
TOR Services: TOR exit and relay nodes may only be run on our Dedicated Server Network with Dedicated Bandwidth.
IRC Services: Legal use of IRC is allowed on our network. IRC may not be used on our network when the intentions are associated with the list of prohibited content.
Freedom of speech: AbeloHost B.V. respects the Dutch Constitution and we do not censor our members on the basis of content unless required by the applicable Dutch laws. The Dutch Constitution guarantees freedom of speech, but places certain limitations in sections 137, 137c, 137d, 137e, 137f, 137g and 137h. The Services shall be used solely for legitimate business and commercial purposes, and you shall not use our Services for activities which, at AbeloHost’s sole discretion, may be illegal, offensive, abusive, or that would expose AbeloHost B.V. to criminal or civil liability. If your data is found to be in breach of this Acceptable Use Policy, AbeloHost B.V. reserves the right to suspend or terminate your account without prior notification.
Use of unlicensed software: While AbeloHost B.V. does not monitor what software a Customer is installing in our Servers. The Customer is fully responsible of getting appropriate software licensing. In the event of a complaint received from a software company we may request to remove the software or get a valid license for it in order to continue operating in our network.
Force Majeure
In no event shall AbeloHost B.V. be held responsible or liable for any delay or failure to fulfill its obligations under this agreement due to, directly or indirectly, forces and circumstances beyond its control. These include, but are not limited to, accidents; acts of war and terrorism; changes in relevant laws or regulations; civil and military disturbances; disruption or outage of communications or power utilities; earthquakes; fires; floods; strikes; storms; work stoppages; natural or nuclear catastrophes; or any other such cause.
AbeloHost B.V. shall not be held responsible or liable for any consequential damage incurred, either directly or indirectly, as a result of its failure to perform its obligations under this agreement due to a force majeure. For the purposes of this agreement, “damage” includes any:
loss of income and/or profits; expenses incurred to prevent or reduce consequential damages; and any damage other than direct damages, including, but not limited to, consequential loss or damage to information and/or data.
In the event that AbeloHost B.V. fails to establish a connection in a timely manner and/or fails to realize the possible SLA as a result of delayed completion of (fixed) telecommunications and/or electricity connections, AbeloHost B.V. shall not be liable for any resulting damage.
In the event of a force majeure, both parties to this agreement undertake that they shall make all reasonable efforts to resume performance as soon as practicable unless agreed otherwise.
In the event of a contractual agreement for crediting period invoices, outages, and/or downtime, between the Client and AbeloHost B.V., the outage and/or downtime monthly period calculation shall include only downtime due to intent or gross negligence on the part of AbeloHost B.V. Cable cuts, both inside and outside AbeloHost B.V.’s network, DDoS attacks, downtime due to hardware and/or software failure, configuration, and software changes shall be covered by or for the Client independently of the outage and/or downtime monthly period calculation.
The Client undertakes to insure their hardware, software, and any related services and/or products. Any such insurance policy must cover the potential loss of income, damage to third parties, and consequential damages arising from force majeure.
The Client is fully responsible for all services received by AbeloHost B.V. In the event that AbeloHost B.V. carries out any repair(s) of fault(s) and/or damage(s) caused by the Client, AbeloHost B.V. shall be reimbursed by the Client for the full amount of expenses incurred. Such repairs include but are not limited to:
Preventing DDoS from attacking the Client;
Repairing electrical faults in the Client’s rack(s); and
IP subnet damage caused by the Client in the server room.
