Acceptable use policy

This Acceptable Use Policy (“AUP”) outlines the terms under which you are permitted to utilize our Services and is hereby incorporated by reference into Abelohost’s Terms of Service. Unless explicitly stated otherwise, any capitalized terms used herein shall bear the same definitions as those found in the Terms of Service.

Abelohost reserves the right to revise or update this AUP at any time without prior notice to you. It is your obligation to review this page periodically to remain informed of any changes that may affect your use of our services.

Prohibited content

You bear full responsibility for all content transmitted, accessed, or otherwise handled through your use of services on Abelohost’s network. It is strictly prohibited to transmit, store, or display any information, material, or data that violates applicable laws or regulations. Furthermore, our services may not be used to assist in, promote, or enable the violation of any particular law, regulation, or this AUP.

The following list contains examples of activities and types of content that are expressly forbidden. This list is not comprehensive and may be updated at Abelohost’s sole discretion. We also reserve the exclusive right to determine whether specific material or behavior is deemed acceptable on our platform.

You may not, either directly or indirectly, use the Services for any of the following activities, as determined solely by Abelohost:

  • Any activity that could result in IP blacklisting by organizations such as Spamhaus;
  • Child sexual abuse material (CSAM) or any depiction of minors in a sexual context (including but not limited to nudity);
  • Adult material involving actual acts of violence;
  • Pornographic content depicting animals (bestiality or zoophilia);
  • Fraudulent or scam-related websites;
  • Spam;
  • Unlawful pharmaceutical sites;
  • Sites relating to payment processing or financial operations of any kind;
  • Websites promoting cheats, hacks, or exploit tools;
  • Content involving virtual currency generators or manipulation tools;
  • Sites connected to forex, banking, or investment schemes;
  • eBook-related content, including distribution platforms;
  • Unlicensed and unauthorized IPTV services;
  • Sale or distribution of counterfeit products/replicas;
  • Mass emailing systems;
  • Reverse proxies;
  • Sale of controlled or illegal substances;
  • Phishing or impersonation websites;
  • Command-and-control interfaces for botnets;
  • DDoS scripts;
  • Brute force attacks;
  • Packet flood scripts;
  • SIP scanning or exploitation tools;
  • IP spoofing attacks;
  • Distribution of viruses, malware, trojans, or similar malicious software;
  • Online survey scams or sites centered around survey generation;
  • Distribution of unauthorized third-party software or inducement to download any such software;
  • Password-cracking tools, bots, or guessing software;
  • Unauthorized scanning of websites or ports;
  • Vulnerability scanners
  • Websites that promote terrorism or any other extremist propaganda.

Additionally, you may not utilize excessive amounts of system or network resources or otherwise operate in a manner that compromises server performance or negatively impacts other clients. Activities considered as resource-intensive and therefore restricted include, but are not limited to:

  • Hosting or linking to an anonymous proxy;
  • Running a file sharing service; or
  • Hosting scripts or processes that negatively impact server health and stability.

If you are uncertain whether your content or project falls within the bounds of this Acceptable Use Policy, contact us in advance of registering and making an account. That way, we will be able to determine whether we can host your website. Please note that Abelohost retains the full authority to make final determinations on what constitutes acceptable use within its network.

Limited content

The following guidelines outline specific restrictions applicable to certain activities conducted on our servers and within our network infrastructure:

TOR Services:

Running TOR exit or relay nodes is permitted exclusively on our dedicated server infrastructure and must utilize dedicated bandwidth. Such services are not allowed on shared or VPS environments.

IRC Services:

The use of Internet Relay Chat (IRC) is permitted on our network, provided it is lawful. Therefore, IRC services that are associated with or facilitate any content outlined in the Prohibited Content section are strictly forbidden.

Freedom of speech:

Abelohost operates under the Dutch Constitution and does not restrict user content unless mandated by applicable Dutch legislation. While freedom of speech is protected under Dutch law, it is subject to specific legal constraints as outlined in Articles 137, 137c, 137d, 137e, 137f, 137g, and 137h. Our services are intended for lawful business and commercial purposes only. You are prohibited from using our services in any manner that Abelohost, in its sole judgment, deems illegal, offensive, or abusive, or which could subject Abelohost to legal liability. Any data or activity found in violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, without prior notice.

Use of unlicensed software:

Abelohost does not actively monitor or inspect the software installed by customers on their servers. Thus, it is the client’s sole responsibility to ensure that all software is properly licensed. Should we receive a complaint from a software rights holder, we may require that you either remove the infringing software or provide proof of valid licensing to continue operating within our network.

Force majeure

In no event shall Abelohost be held responsible or liable for any delay or failure to fulfill its obligations under this agreement due to, directly or indirectly, forces and circumstances beyond its control. These include, but are not limited to, accidents; acts of war and terrorism; changes in relevant laws or regulations; civil and military disturbances; disruption or outage of communications or power utilities; earthquakes; fires; floods; strikes; storms; work stoppages; natural or nuclear catastrophes; or any other such cause.

Abelohost shall not be held responsible or liable for any consequential damage incurred, either directly or indirectly, as a result of its failure to perform its obligations under this agreement due to a force majeure. For the purposes of this agreement, “damage” includes any: loss of income and/or profits; expenses incurred to prevent or reduce consequential damages; and any damage other than direct damages, including, but not limited to, consequential loss or damage to information and/or data.

In the event that Abelohost fails to establish a connection in a timely manner and/or fails to realize the possible SLA as a result of delayed completion of (fixed) telecommunications and/or electricity connections, Abelohost shall not be liable for any resulting damage.

In the event of a force majeure, both parties to this agreement undertake that they shall make all reasonable efforts to resume performance as soon as practicable unless agreed otherwise.

In the event of a contractual agreement for crediting period invoices, outages, and/or downtime, between the Client and Abelohost, the outage and/or downtime monthly period calculation shall include only downtime due to intent or gross negligence on the part of Abelohost. Cable cuts, both inside and outside Abelohost’s network, DDoS attacks, downtime due to hardware and/or software failure, configuration, and software changes shall be covered by or for the Client independently of the outage and/or downtime monthly period calculation.

The Client undertakes to insure their hardware, software, and any related services and/or products. Any such insurance policy must cover the potential loss of income, damage to third parties, and consequential damages arising from force majeure.

The Client is fully responsible for all services received by Abelohost. In the event that Abelohost carries out any repair(s) of fault(s) and/or damage(s) caused by the Client, Abelohost shall be reimbursed by the Client for the full amount of expenses incurred. Such repairs include but are not limited to:

  • Preventing DDoS from attacking the Client;
  • Repairing electrical faults in the Client’s rack(s); and
  • IP subnet damage caused by the Client in the server room.
